The following is the Privacy Policy of Back in Motion Rehab Inc. (dba Back in Motion Health).

Information Collected

Information that we collect directly from you.

We may collect some or all of the following personal information directly from you: 

• your name
• your contact information (email, phone, mailing address)

Information collected through our website.

We or the service providers that help us maintain and operate our website may ‎also automatically collect ‎information relating to your access to and use of our website through cookies, pixel tags, web beacons, ‎local storage, and other or other automatic data collection technologies. For more information, please see the “Cookies and Similar Technologies” section below.

Purpose of Collecting Information

When collecting personal information, we will state the purpose of collection and will provide, on request, contact information for the Privacy Officer who can answer questions about the collection.

We collect, use and disclose your personal information for the following purposes:

• to provide and administer products and services you request, and to disclose the information for any purpose related to the provision of requested products and services.
• to operate, maintain and improve our website and online services‎.
• to authenticate your identity.
• to provide personal information to third-party suppliers of products and services (as discussed in more detail below).
• to manage or transfer our assets or liabilities, for example, in the case of an acquisition or merger, the provision of security for a credit facility or the change of a supplier of products or services.
• to maintain accurate customer records.
• to protect us, yourself and others from fraud and error and to safeguard our business interests.
• to provide reports to credit bureaus.
• to collect debts owed to us.
• to comply with legal and regulatory requirements; and
• to distribute to third parties including financial institutions, payment processors, lawyers, financial institutions, and government licensing bodies for any of the above purposes.

The collections, uses and disclosures listed above are a reasonably necessary part of your relationship with us. We may also collect, use and disclose your personal information as follows:

• we may use your personal information to offer additional or alternate services to you and may add your personal information to customer lists for this purpose; and

Consent

We will obtain your consent to collect, use or disclose personal information except where we are authorized or required by law to do so without consent. For example, we may collect, use or disclose personal information without your knowledge or consent where:

• the information is publicly available, as defined by statute or regulation.
• we are obtaining legal advice; or
• we reasonably expect that obtaining consent would compromise an investigation or proceeding.

Limits on Collection of Personal Information

We will not collect personal information indiscriminately but will limit the collection of personal information to that which is reasonable and necessary. We will also collect personal information as authorized by law.

Limits for Using, Disclosing and Retaining Personal Information

We will only use or disclose your personal information for the purposes set out above and as authorized by law.

We will keep personal information used to make a decision affecting you for at least one year after using it to make the decision.

We will destroy, erase or make anonymous documents or other records containing personal information as soon as it is reasonable to assume that the original purpose is no longer being served by retaining the information and retention is no longer necessary for a legal or business purpose.

We will take due care when destroying personal information to prevent unauthorized access to the information.

Disclosure of Personal Information

We may disclose your personal information to a third party without your consent if permitted or required ‎by applicable law. We may also disclose your personal information, in accordance with applicable law, in ‎connection with ‎a corporate re-organization, a merger or amalgamation with another entity, or a sale of ‎all or a ‎substantial portion of our assets provided that the disclosed information continues to be used ‎solely for ‎the purposes permitted by this privacy policy by the entity acquiring the information.‎

Service Providers

We may retain agents, subcontractors or service providers from time to time in relation to our business or the products or services that we provide. If we require a service provider to deal with your personal information, we will take reasonable steps to ensure that the service provider adheres to privacy procedures and will keep your personal information confidential. We will not provide more information than is necessary to the service provider and will ensure that the information is returned or destroyed once the purpose for which it was given is filled.

Our service providers may be located outside of your province or territory of residence, including outside of Canada, and you acknowledge that personal information may be processed and stored in foreign jurisdictions and that the governments, courts or law enforcement or regulatory agencies in those jurisdictions may be able to obtain disclosure of that personal information through the laws of the foreign jurisdiction.

Accuracy

We will make a reasonable effort to ensure that the personal information we are using or disclosing is accurate and complete.

If you demonstrate that your personal information is inaccurate or incomplete, we will amend the information as required. If appropriate, we will send the amended information to third parties to whom the information has been disclosed.

When a challenge regarding the accuracy of personal information is not resolved to your satisfaction, we will annotate the personal information under our control with a note that the correction was requested but not made.

Safeguarding Personal Information

We protect the personal information in our custody or control by making reasonable security arrangements designed to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks.

We will take reasonable steps, through contractual or other reasonable means, to ensure that a comparable level of personal information protection is implemented by our suppliers and agents.

Note that confidentiality and security are not assured when information is transmitted through e-mail or other digital or wireless communication. Please notify our Privacy Officer in writing if you do not want us to communicate with you through these means.

Providing Access

You have a right to access your personal information held by us.

Upon written request and authentication of identity, we will provide you with your personal information under our control. We will also give you information about how that information is being used and a description of the individuals and organizations to whom that information has been disclosed. We may charge you a reasonable fee for doing so.

We may need to request specific information from you to help us confirm your identity and ‎ensure your ‎right to access the information (or to exercise any of your other rights). This is ‎another appropriate ‎security measure to ensure that personal information is not disclosed to any ‎person who has no right to ‎receive it.‎

We will make the information available within 30 days of receiving a written request or provide written notice where additional time is required to fulfil the request.

In some situations, we may not be able to provide access to certain personal information (e.g., if disclosure would reveal personal information about another individual, the personal information is protected by solicitor/client privilege, the information was collected for the purposes of an investigation or where disclosure of the information would reveal confidential commercial information that could harm our competitive position). We may also be prevented by law from providing access to certain personal information.

Where an access request is refused, we will notify you in writing, document the reasons for refusal and outline further steps which are available to you.

Third-Party Sites and Services

Our website may include links to third-party websites, plug-ins, services, social networks, or applications. Clicking on those links or enabling those connections may allow the third party to collect or share information about you. You understand that if you follow a link to a third-party website or engage a third-party plugin, the third parties have their own privacy policies and we do not accept any responsibility or liability for their policies. We do not control these third-party websites or services, and we encourage you to read the privacy policy of every website you visit.

Cookies and Similar Technologies

We may use cookies, pixels, tags, web beacons, ‎local storage, or other automatic data collection technologies as you navigate through and interact with our website to collect certain information about your equipment, browsing activity, and patterns, including:

• details of your visits to our website, including traffic data, the length of time you visit or use our site, pages you view, links you click and other communication data and the resources that you access and use on the website.
• information about your computer and internet connection, including your IP address, operating system, and browser type.

We use the information collected through these technologies to:

• recognize your computer or device when you visit our website.
• track you as you navigate our website, including when submitting a web form, or booking an ‎appointment.

What are cookies?

A cookie is a small file containing a unique identifier that is placed in the web browser of your ‎computer or mobile device when you visit a website. Cookies and similar technologies (which include ‎pixels, tags, web beacons and software development kits) (together “cookies”) enable ‎site operators to recognize your device and collect information from it when you interact with a website. • Strictly ‎Necessary ‎Cookies.  These cookies are necessary for our website to ‎function and cannot be switched off in our ‎systems. What third-party advertising and analytics cookies do we use?

Several third-party advertising and analytics cookies are set up on our website, some of which depend on how you use our website. Our advertising partners may use pixels or similar technology to measure the success of the sponsored posts or other advertising products they use. (A “pixel” (also sometimes called a web beacon, or clear GIF) is a tiny piece of code, invisible to the user, placed on a webpage or in an email and used in combination with a cookie, to link a given activity or impression back to the user; the advertiser includes it in its content so it can measure whether our members interact with that content (for example, by clicking to view an offer.) We may set our own pixel on an advertiser’s website so we can measure whether our users found the advertiser’s content effective or interesting, by determining whether the sponsored post prompted members to take advantage of the advertised offer. This information helps us assess whether sponsored posts and other advertising offers are relevant and interesting to our members and successful for the advertiser.

Third-Party Analytics

We may use third-party analytics tools, including Google Analytics (see below) to collect, monitor and analyze information to improve functionality and user-friendliness, and to better tailor our website and online services to visitors’ needs. We may share information from these sources with third parties, each of which has its privacy policy addressing how they use the information and any choices you have about their collection and use of information. Google Analytics

Google Analytics is a web analytics service provided by Google, Inc. (“Google”). Google uses cookies to help us analyze how users use our Services. For more information about Google Analytics cookies, please see Google’s help pages and privacy policy. Google has developed the Google Analytics opt-out browser add-on; if you want to opt out of Google Analytics, you can download and install the add-on for your web browser here. The information generated by the cookie about your use of one of our websites and online services (including your IP address) will be transmitted to and stored by Google on servers in the United States. On behalf of our services, Google will use this information for the purpose of evaluating your use of our website and online services, compiling reports on your activity for us and third parties who help operate and provide services related to our website and online services. Updates to our Privacy Policy

‎We may update this Policy from time to time to ensure ongoing compliance with applicable laws and for ‎any other purpose that we deem reasonably necessary. We therefore recommend that you review ‎it ‎frequently. You can tell if the Policy has changed by checking the revision date that appears at the top of this Policy.‎ We will announce changes to this Policy on our website or through ‎similar means for ‎a reasonable time before and after the changes take effect. ‎Where required by applicable law, we may ‎need to ask you to confirm your consent to the ‎processing of your personal information.
